TRADEMARK / COPYRIGHT INFRINGEMENT & REMEDIES AVAILABLE
Trademark Infringement is the unauthorized use of a trademark or service mark (or a similar mark) on competing or related goods and services.
There are several remedies available to the owner of a federal trademark in the event of infringement or theft of a trademark, such as a logo, name, or slogan. Remedies are provided under a federal statute, the Trademark Counterfeiting Act of 1984 (18 U.S.C. § 2320), and are available only to owners of federally registered marks. However, relief may also be obtained under the common law of certain states as well.
These remedies include Monetary Relief, Equitable Relief, Seizures and Costs and Attorney's Fees.
